Terms of Service

1. Introduction and Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the OnlyErase platform and services (the "Service"), operated by Brand Enforcer – Tomasz Struk (VAT: PL9662097635), doing business as OnlyErase ("OnlyErase", "we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service.

By creating an account, you represent and warrant that:

• You are legally capable of entering into a binding agreement
• You are at least 18 years of age
• You own or control the copyright to all content you submit
• All submitted content depicts only yourself
• You were 18 or older at the time the content was created

3. Description of the Service

OnlyErase provides copyright monitoring and enforcement assistance, including:

• Image fingerprinting and matching
• Detection of potential unauthorized use
• Human-reviewed copyright enforcement actions
• Submission of takedown notices on your behalf where authorized

OnlyErase operates on a best-effort basis and does not guarantee detection, removal, or enforcement outcomes.

4. Account Registration and Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Ensuring the accuracy of information you provide

You must notify us immediately of any unauthorized use of your account.

5. Content Ownership and User Obligations

5.1 Ownership and Authorization

You may only upload content that you own or have full legal rights to control.

You explicitly agree that:

• You will not upload images depicting another person
• You will not upload images you do not own
• You will not use the Service to remove or suppress lawful content belonging to others

Using the Service to submit takedown requests for content you do not own is strictly prohibited.

5.2 Misuse and Abuse

You may not use the Service to:

• Submit false or misleading takedown notices
• Harass, censor, or intimidate others
• Exploit or manipulate the detection system
• Circumvent usage limits or safeguards
• Upload third-party content for removal
• Engage in fraudulent, deceptive, or unlawful activity

6. Trusted Representatives

6.1 Appointment

OnlyErase allows account holders ("Creators") to designate one or more Trusted Representatives to assist with managing certain Service functions.

A Trusted Representative is an individual authorized by the Creator to act on their behalf within the limited scope defined below.

6.2 Scope of Authority

Trusted Representatives may:

• Submit URLs for review
• View detection results
• Review potential infringements
• Initiate takedown requests for review

Trusted Representatives may not:

• Upload or remove protected images
• Modify billing or subscriptions
• Sign or amend authorization documents
• Transfer account ownership
• Add additional representatives

OnlyErase may modify available permissions at any time.

6.3 Responsibility

Creators remain fully responsible for:

• All actions taken by their Trusted Representatives
• Accuracy of submissions made on their behalf
• Compliance with these Terms

OnlyErase is not responsible for disputes between Creators and their Trusted Representatives.

6.4 Revocation

Creators may revoke Trusted Representative access at any time through their account settings. Revocation is effective immediately.

7. Copyright Enforcement and Takedowns

By using the Service, you authorize OnlyErase to assist with copyright monitoring and to submit takedown notices on your behalf where applicable.

All enforcement actions:

• Are subject to human review
• May be declined at our discretion
• May be suspended if disputed or challenged

OnlyErase does not provide legal advice.

8. Suspension and Termination

We reserve the right to suspend or terminate your account, with or without notice, if we determine that you:

• Violated these Terms
• Uploaded content not depicting yourself
• Uploaded content you do not own
• Submitted false or abusive takedown requests
• Attempted to exploit or manipulate the Service
• Used the Service unlawfully or fraudulently
• Posed legal, reputational, or operational risk to OnlyErase

Termination may result in immediate loss of access and deletion of associated data, subject to legal retention requirements.

9. Fees and Subscriptions

Access to the Service requires an active paid subscription.

• Fees are billed in advance
• Subscriptions renew automatically unless canceled
• You may cancel at any time via your account dashboard
• No refunds are provided except where required by law

10. Disclaimer of Warranties

The Service is provided "as is" and "as available".

To the maximum extent permitted by law, OnlyErase disclaims all warranties, including:

• Merchantability
• Fitness for a particular purpose
• Accuracy or completeness of detection results
• Guaranteed removal or enforcement outcomes

11. Limitation of Liability

To the maximum extent permitted by law, OnlyErase shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of income, revenue, or reputation
• Failure to detect or remove infringing content
• Actions taken by third-party platforms

Our total liability shall not exceed the amount paid by you for the Service in the preceding 12 months.

12. Indemnification

You agree to indemnify and hold harmless OnlyErase from any claims, damages, or liabilities arising from:

• Content you submit
• Takedown requests made on your behalf
• Misuse of the Service
• Violation of these Terms

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Poland, without regard to conflict-of-law principles.

Any disputes shall be subject to the exclusive jurisdiction of Polish courts.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
